Terms of Service

1.1. These Terms of Service ("Terms") constitute a legally binding agreement between you ("Renter," "you," or "your") and Musiaro Rentals, LLC ("Musiaro," "Company," "we," "us," or "our"), a Florida limited liability company headquartered in Pembroke Pines, FL 33028.

1.2. By accessing our website at musiarorentals.com, creating an account, making a reservation, or renting any vehicle from Musiaro Rentals, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree with any provision of these Terms, you must immediately discontinue use of our services.

1.3. These Terms apply to all services provided by Musiaro Rentals, including but not limited to vehicle rentals, deliveries, vehicle listing services for third-party vehicle owners, and any ancillary services offered through our platform.

1.4. Your continued use of our services following any modification to these Terms constitutes acceptance of such modifications. It is your sole responsibility to review these Terms periodically for updates.

2.1. Minimum Age. You must be at least twenty-five (25) years of age at the time of rental. No exceptions will be made to this requirement regardless of driving experience, insurance coverage, or any other factor.

2.2. Valid Driver's License. You must possess a valid, unrestricted driver's license issued by a U.S. state or territory, or a valid international driver's license accompanied by an International Driving Permit (IDP). The license must have been held for a minimum of three (3) consecutive years. Learner's permits, temporary licenses, and restricted licenses are not accepted.

2.3. Insurance. You must maintain active, valid automobile insurance that meets or exceeds the coverage requirements set forth in our Rental Agreement and Insurance Policy. Proof of insurance must be provided prior to vehicle delivery.

2.4. Driving Record. Musiaro reserves the absolute right to deny rental to any individual with a history of DUI/DWI convictions, reckless driving citations, license suspensions or revocations, or three (3) or more moving violations within the preceding thirty-six (36) months. You authorize Musiaro to conduct a driving record check at our discretion.

2.5. Credit Verification. Musiaro reserves the right to perform credit checks and may decline service based on creditworthiness at our sole discretion. A valid major credit card in the Renter's name is required for all transactions.

2.6. Verification. Musiaro may require additional identity verification documents, including but not limited to a secondary form of government-issued identification, utility bills, or bank statements. Failure to provide requested documentation constitutes grounds for denial of service.

3.1. Reservation Requests. All bookings are subject to vehicle availability and Musiaro's approval. Submitting a reservation request does not guarantee vehicle availability. A reservation is confirmed only upon receipt of written confirmation from Musiaro and successful processing of the required deposit.

3.2. Rental Period. The minimum rental period is one (1) day (24 hours). The maximum rental period is thirty (30) consecutive days. Extensions beyond thirty (30) days require prior written approval from Musiaro and may be subject to adjusted pricing and additional terms.

3.3. Deposit. A non-refundable booking deposit equal to twenty-five percent (25%) of the total rental amount is required at the time of reservation confirmation. The remaining balance is due in full no later than twenty-four (24) hours prior to the scheduled vehicle delivery or pickup.

3.4. Pricing. All prices quoted are in U.S. Dollars. Pricing is subject to change without notice prior to reservation confirmation. Confirmed reservations will be honored at the quoted rate. Taxes, fees, delivery charges, and optional add-ons are additional unless expressly stated otherwise.

3.5. Vehicle Substitution. Musiaro reserves the right to substitute the reserved vehicle with a comparable or upgraded vehicle of similar class and value in the event the originally reserved vehicle becomes unavailable due to mechanical issues, prior renter damage, or other circumstances beyond our reasonable control. No price adjustment shall apply for upgrades.

4.1. More Than 48 Hours Before Rental. Cancellations made more than forty-eight (48) hours prior to the scheduled rental start time will receive a full refund of amounts paid, minus a non-refundable administrative processing fee of $150.00 or 5% of the total rental amount, whichever is greater.

4.2. Between 24 and 48 Hours Before Rental. Cancellations made between twenty-four (24) and forty-eight (48) hours prior to the scheduled rental start time will receive a refund of fifty percent (50%) of amounts paid. The remaining fifty percent (50%) is forfeited as a cancellation fee.

4.3. Less Than 24 Hours Before Rental. Cancellations made less than twenty-four (24) hours prior to the scheduled rental start time, or failure to appear for a scheduled pickup/delivery ("no-show"), will result in complete forfeiture of all amounts paid. No refund will be issued.

4.4. Cancellation by Musiaro. Musiaro reserves the right to cancel any reservation at any time and for any reason at our sole discretion, including but not limited to concerns regarding Renter eligibility, vehicle availability, weather conditions, or safety. In the event of cancellation initiated by Musiaro, a full refund of all amounts paid will be issued within ten (10) business days. Musiaro shall have no further liability arising from such cancellation.

4.5. Refund Processing. All approved refunds will be processed to the original payment method within ten (10) to fifteen (15) business days. Musiaro is not responsible for delays attributable to financial institutions or payment processors.

5.1. Amount. A refundable security deposit equal to twenty-five percent (25%) of the total rental cost shall be collected via credit card authorization or direct charge prior to vehicle delivery. For exotic and supercar rentals, Musiaro reserves the right to require a higher security deposit at our sole discretion.

5.2. Hold Period. The security deposit or authorization hold shall be maintained for a period of fourteen (14) calendar days following the vehicle return date. This hold period allows for a thorough post-rental inspection, damage assessment, mileage verification, toll processing, and traffic violation review.

5.3. Deductions. Musiaro reserves the right to deduct from the security deposit any amounts owed for, including but not limited to: vehicle damage, excessive wear and tear, interior cleaning fees, smoking odor remediation, mileage overages, fuel replacement, late return penalties, toll charges, traffic violations, parking citations, and any other charges incurred during the rental period.

5.4. Excess Charges. In the event that deductions exceed the security deposit amount, the Renter shall be liable for the full remaining balance and authorizes Musiaro to charge the credit card on file for any such excess. If the credit card cannot be charged, the Renter agrees to remit payment within seven (7) business days of written notice.

5.5. Release. Provided no deductions are applicable, the security deposit or authorization hold will be released within fourteen (14) calendar days of vehicle return. Release timing may vary depending on the Renter's financial institution.

6.1. Full Liability. The Renter assumes full and complete financial responsibility for any and all damage to the rental vehicle occurring during the rental period, regardless of fault, cause, or circumstance. This includes damage caused by the Renter, authorized drivers, third parties, acts of nature, road debris, vandalism, theft, or any other cause whatsoever.

6.2. Damage Assessment. All damage shall be assessed by Musiaro or its designated repair facility at prevailing market rates. Musiaro's assessment of damage and associated repair costs shall be final, binding, and conclusive. The Renter waives any right to dispute Musiaro's damage assessment except in cases of demonstrable fraud.

6.3. Loss of Use. In addition to repair costs, the Renter shall be liable for loss of use charges at the vehicle's daily rental rate for each day the vehicle is unavailable for rental due to repairs, regardless of whether Musiaro had a confirmed reservation for those dates.

6.4. Diminished Value. The Renter shall be liable for any diminished value of the vehicle resulting from damage sustained during the rental period, as determined by an independent appraiser selected by Musiaro at the Renter's expense.

6.5. Interior Damage. Excessive interior soiling, stains, burns, tears, odors (including but not limited to smoke, vape, and pet odors), or any interior damage shall be charged at prevailing professional restoration rates, with a minimum charge of $500.00.

6.6. Tire and Wheel Damage. Damage to tires, wheels, and rims, including but not limited to curb rash, flat tires, and sidewall damage, is the sole responsibility of the Renter and shall be charged at OEM replacement cost plus labor.

7.1. Included Mileage. Each rental day includes one hundred fifty (150) miles of driving ("Included Mileage"). Mileage is calculated based on the vehicle's odometer reading at the time of delivery and return.

7.2. Excess Mileage — Exotic & Supercar Class. For vehicles classified as exotic or supercar (including but not limited to Lamborghini, Ferrari, McLaren, Rolls-Royce, Bentley, and similar marques), excess mileage beyond the Included Mileage shall be charged at a rate of $3.00 per mile.

7.3. Excess Mileage — Luxury Class. For vehicles classified as luxury (including but not limited to Mercedes-Benz, BMW, Porsche Cayenne/Panamera, Audi, and similar marques), excess mileage beyond the Included Mileage shall be charged at a rate of $2.00 per mile.

7.4. Mileage Packages. Additional mileage may be purchased in advance at a discounted rate, subject to availability and Musiaro's approval. Pre-purchased mileage is non-refundable and non-transferable.

7.5. Odometer Tampering. Any attempt to tamper with, disconnect, or manipulate the vehicle's odometer or GPS tracking system shall result in immediate termination of the rental, forfeiture of all deposits and payments, and may subject the Renter to criminal prosecution to the fullest extent of the law.

8.1. The rental vehicle shall not, under any circumstances, be used for or subjected to any of the following prohibited activities. Violation of any prohibition constitutes a material breach of these Terms and shall result in immediate termination of the rental, forfeiture of all deposits and payments, and full financial liability for any resulting damages:

(a) Racing & Reckless Driving. Any form of racing, speed contests, autocross, track use, stunt driving, drifting, burnouts, or any operation in a reckless, abusive, or performance-testing manner.

(b) Off-Road Use. Operation on unpaved roads, beaches, dirt roads, gravel roads, construction sites, or any surface not constituting a properly maintained, paved public roadway.

(c) Smoking & Vaping. Smoking of any substance (tobacco, cannabis, or otherwise) or use of any vaping device inside the vehicle. A minimum cleaning and remediation fee of $750.00 shall apply.

(d) Pets & Animals. Transporting any animal or pet inside the vehicle at any time. A minimum cleaning fee of $500.00 shall apply, plus charges for any damage caused.

(e) Subletting & Unauthorized Use. Subletting, re-renting, or otherwise permitting the vehicle to be operated by any person not listed as an authorized driver on the Rental Agreement.

(f) Leaving the State of Florida. Operating the vehicle outside the geographic boundaries of the State of Florida without prior written authorization from Musiaro.

(g) Towing & Hauling. Using the vehicle to tow, push, or transport any trailer, vehicle, or equipment, or to carry loads exceeding the manufacturer's specifications.

(h) Impaired Driving. Operating the vehicle while under the influence of alcohol, drugs, narcotics, or any substance that impairs driving ability. Any DUI/DWI arrest during the rental period shall result in immediate termination and the Renter shall bear all legal, towing, storage, and associated costs.

(i) Illegal Activities. Use of the vehicle in connection with any criminal activity, illegal purpose, or violation of any federal, state, or local law.

(j) Commercial Use. Use of the vehicle for hire, ride-sharing services, delivery services, or any commercial purpose without prior written consent from Musiaro.

(k) Overloading. Transporting more passengers than the vehicle's designated seating capacity or carrying cargo that may damage the vehicle's interior, trunk, or exterior.

9.1. Scheduled Return. The vehicle must be returned at the date, time, and location specified in the Rental Agreement. Any deviation requires prior written approval from Musiaro.

9.2. Late Return Fee. Late returns shall be assessed a penalty of $200.00 per hour or any fraction thereof, commencing from the scheduled return time. This fee is in addition to any applicable daily rental charges.

9.3. Unauthorized Retention. If the vehicle is not returned within four (4) hours of the scheduled return time without prior authorization, Musiaro reserves the right to report the vehicle as stolen to law enforcement, activate remote recovery systems, and/or dispatch recovery agents at the Renter's sole expense. All recovery, towing, storage, legal, and administrative costs shall be borne exclusively by the Renter.

9.4. Extension Requests. Rental extensions must be requested and approved in writing at least four (4) hours prior to the scheduled return time. Extensions are subject to availability, adjusted pricing, and Musiaro's sole discretion.

10.1. Same Condition. The vehicle must be returned in the same condition as it was delivered, subject to normal and reasonable wear consistent with the rental period. "Normal wear" is defined solely at Musiaro's discretion.

10.2. Fuel Policy. The vehicle shall be delivered with a full tank of fuel and must be returned with a full tank of the manufacturer-specified fuel grade. Failure to return the vehicle with a full tank will result in a refueling charge at $12.00 per gallon plus a $75.00 refueling service fee.

10.3. Cleanliness. The vehicle must be returned in a reasonably clean condition. Excessive dirt, stains, or soiling requiring professional cleaning beyond standard detailing will be charged at prevailing rates, with a minimum charge of $250.00.

10.4. Personal Property. Musiaro assumes no responsibility or liability for personal property left in the vehicle. Items not claimed within seven (7) days of rental conclusion will be disposed of at Musiaro's discretion.

11.1. The Renter agrees to indemnify, defend, and hold harmless Musiaro Rentals, LLC, its officers, directors, members, managers, employees, agents, affiliates, successors, and assigns (collectively, "Indemnified Parties") from and against any and all claims, demands, actions, suits, proceedings, losses, damages, liabilities, judgments, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or in connection with:

(a) The Renter's use, operation, or possession of the rental vehicle;

(b) Any breach or violation of these Terms by the Renter or any authorized driver;

(c) Any accident, injury, death, or property damage involving the rental vehicle during the rental period;

(d) Any traffic violations, citations, fines, penalties, or toll charges incurred during the rental period;

(e) Any claims by third parties arising from the Renter's operation of the vehicle;

(f) Any misrepresentation by the Renter regarding eligibility, insurance coverage, or driving history.

11.2. This indemnification obligation shall survive the termination or expiration of the rental period and these Terms.

12.1. No Consequential Damages. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MUSIARO RENTALS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, GOODWILL, USE, DATA, BUSINESS OPPORTUNITIES, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH THE RENTAL, EVEN IF MUSIARO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12.2. Maximum Liability. In no event shall Musiaro's total aggregate liability to the Renter for all claims arising out of or in connection with these Terms or the rental exceed the total rental fees actually paid by the Renter for the specific rental giving rise to the claim.

12.3. No Warranty. THE VEHICLE IS PROVIDED "AS IS" AND "AS AVAILABLE." MUSIARO MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. MUSIARO DOES NOT WARRANT THAT THE VEHICLE WILL BE FREE FROM MECHANICAL ISSUES OR DEFECTS.

12.4. Assumption of Risk. The Renter acknowledges and agrees that the operation of motor vehicles, particularly high-performance luxury and exotic vehicles, involves inherent risks, including the risk of serious bodily injury or death. The Renter voluntarily assumes all such risks.

13.1. Musiaro shall not be liable for any delay or failure to perform its obligations under these Terms if such delay or failure results from circumstances beyond Musiaro's reasonable control, including but not limited to: acts of God, natural disasters, hurricanes, tropical storms, flooding, earthquakes, epidemics, pandemics, government actions or orders, civil unrest, war, terrorism, fire, power outages, internet or telecommunications failures, supply chain disruptions, or any other event beyond reasonable control ("Force Majeure Event").

13.2. In the event of a Force Majeure Event, Musiaro shall provide notice to the Renter as soon as reasonably practicable. Musiaro's obligations shall be suspended for the duration of the Force Majeure Event. Musiaro may, at its sole discretion, offer a credit, rescheduling, or partial refund, but shall have no obligation to do so.

14.1. Mandatory Arbitration. Any dispute, controversy, or claim arising out of or relating to these Terms, the Rental Agreement, or any rental transaction, including the determination of the scope or applicability of this agreement to arbitrate, shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules. The arbitration shall be conducted in Broward County, Florida.

14.2. Waiver of Class Action. THE RENTER AGREES THAT ALL CLAIMS SHALL BE BROUGHT IN THE RENTER'S INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. THE ARBITRATOR SHALL NOT HAVE THE AUTHORITY TO CONSOLIDATE CLAIMS OR TO CONDUCT CLASS-WIDE ARBITRATION.

14.3. Waiver of Jury Trial. TO THE FULLEST EXTENT PERMITTED BY LAW, THE RENTER HEREBY IRREVOCABLY WAIVES ANY RIGHT TO A TRIAL BY JURY IN ANY ACTION ARISING OUT OF OR RELATED TO THESE TERMS.

14.4. Costs. Each party shall bear its own costs and attorneys' fees in connection with any arbitration. However, the prevailing party in any arbitration shall be entitled to recover its reasonable attorneys' fees and costs from the non-prevailing party.

14.5. Statute of Limitations. Any claim or cause of action arising out of or related to these Terms must be filed within one (1) year after the cause of action accrues; otherwise, such claim or cause of action is permanently barred.

15.1. Musiaro reserves the right to modify, amend, or update these Terms at any time and at our sole discretion, with or without prior notice. The "Last Updated" date at the top of these Terms will be revised accordingly.

15.2. It is the Renter's responsibility to review these Terms periodically. Continued use of Musiaro's services following any modifications constitutes acceptance of the revised Terms.

15.3. For active reservations, the Terms in effect at the time of reservation confirmation shall govern that specific rental, unless the modified Terms are required by applicable law.

16.1. These Terms shall be governed by, construed, and enforced in accordance with the laws of the State of Florida, without regard to its conflict of laws principles.

16.2. To the extent any dispute is not subject to arbitration, the Renter consents to the exclusive jurisdiction and venue of the state and federal courts located in Broward County, Florida.

16.3. If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
