1. Insurance Overview
1.1. This Insurance Policy ("Policy") outlines the insurance requirements, coverage options, exclusions, and claims procedures applicable to all vehicle rentals through Musiaro Rentals, LLC ("Musiaro," "Company," "we," "us," or "our"), headquartered in Pembroke Pines, FL 33028.
1.2. Musiaro Rentals specializes in luxury and exotic vehicle rentals. Due to the exceptionally high value of the vehicles in our fleet, insurance coverage requirements are correspondingly higher than standard rental car operations. Renters are strongly advised to review their personal insurance policies carefully and consult with their insurance agent prior to booking.
1.3. This Policy is supplementary to and should be read in conjunction with our Terms of Service, Rental Agreement, and Privacy Policy. In the event of any conflict, the more protective provision (from Musiaro's perspective) shall control.
1.4. IMPORTANT NOTICE: This document describes insurance requirements and supplemental coverage options offered by Musiaro. It is not an insurance policy issued by an insurance company. Musiaro is not an insurance provider. Supplemental coverage options described herein are contractual liability waivers and protections offered directly by Musiaro, subject to their respective terms and conditions.
2. Required Coverage Minimums
2.1. All Renters must maintain personal automobile insurance that meets or exceeds the following minimum coverage requirements for the entire duration of the rental period:
(a) Bodily Injury Liability: $300,000 per person / $300,000 per occurrence. This significantly exceeds Florida's state minimum requirements, which are insufficient for luxury and exotic vehicle rentals.
(b) Property Damage Liability: $100,000 per occurrence minimum.
(c) Comprehensive Coverage: Required with a maximum deductible of $1,000. Must cover the rental vehicle.
(d) Collision Coverage: Required with a maximum deductible of $1,000. Must cover the rental vehicle.
(e) Uninsured/Underinsured Motorist (UM/UIM): $100,000 per occurrence minimum.
2.2. Rental Vehicle Coverage. The Renter's personal insurance must explicitly extend coverage to rental vehicles. Many standard auto insurance policies do cover rental vehicles; however, some exclude high-value, exotic, or specialty vehicles. It is the Renter's sole responsibility to confirm with their insurance carrier that their policy covers the specific vehicle being rented.
2.3. Credit Card Coverage. Credit card rental car insurance benefits are generally NOT accepted as primary or sole coverage for Musiaro rentals. Many credit card programs exclude exotic, luxury, and high-value vehicles from their coverage. The Renter should not rely on credit card coverage without written confirmation from the card issuer that the specific rental vehicle is covered.
2.4. Proof Required. A valid insurance declaration page or certificate of insurance must be submitted at least twenty-four (24) hours prior to vehicle delivery. Musiaro reserves the right to verify all coverage directly with the insurance carrier and to deny the rental if coverage is deemed insufficient.
3. Musiaro Supplemental Coverage Options
3.1. Musiaro offers the following optional supplemental coverage packages to provide additional protection beyond the Renter's personal insurance. These are not insurance products but contractual liability waivers provided by Musiaro.
3.2. Standard Protection Package (SPP). Available for an additional daily fee (quoted at time of booking). The SPP provides:
(a) Collision Damage Waiver (CDW) reducing the Renter's out-of-pocket liability for collision damage to the applicable deductible amount;
(b) Deductible of $5,000 for luxury class vehicles and $10,000 for exotic/supercar class vehicles;
(c) Coverage for windshield and glass damage (subject to deductible);
(d) Roadside assistance during rental hours.
3.3. Premium Protection Package (PPP). Available for an additional daily fee (quoted at time of booking). The PPP provides everything in the SPP plus:
(a) Reduced deductible of $2,500 for luxury class vehicles and $5,000 for exotic/supercar class vehicles;
(b) Tire and wheel protection covering damage from road hazards (excludes curb damage caused by driver error);
(c) Loss-of-use waiver covering up to five (5) days of lost rental income during repairs;
(d) Interior protection covering accidental stains and minor interior damage up to $500.
3.4. Elite Protection Package (EPP). Our most comprehensive coverage option. Available for an additional daily fee (quoted at time of booking). The EPP provides everything in the PPP plus:
(a) Reduced deductible of $1,000 for luxury class vehicles and $2,500 for exotic/supercar class vehicles;
(b) Diminished value waiver for first occurrence;
(c) Comprehensive coverage for theft (subject to police report and cooperation requirements);
(d) Extended loss-of-use waiver covering up to ten (10) days;
(e) Personal effects coverage up to $1,000 for items stolen from a locked vehicle (police report required).
3.5. Package Limitations. All supplemental coverage packages are subject to the exclusions set forth in Section 5 of this Policy. Supplemental coverage is non-refundable once the rental period begins. Coverage is voided by any breach of the Terms of Service or Rental Agreement.
4. What Is Covered
4.1. Subject to the applicable supplemental coverage package and the Renter's personal insurance, the following types of loss or damage may be covered:
(a) Collision damage resulting from an accident during normal, lawful operation of the vehicle;
(b) Comprehensive losses including weather damage (hail, flooding, hurricanes), falling objects, and fire (when not caused by Renter negligence);
(c) Vandalism by unidentified third parties (police report required);
(d) Theft of the vehicle (police report and full cooperation required; subject to Elite Protection Package or Renter's personal comprehensive coverage);
(e) Windshield and auto glass damage from road debris (subject to applicable deductible);
(f) Third-party bodily injury and property damage claims (through Renter's liability coverage).
4.2. Priority of Coverage. The Renter's personal automobile insurance shall be the primary and first source of coverage for any loss or claim. Musiaro's supplemental coverage, if purchased, shall apply only after the Renter's personal insurance has been exhausted or has denied the claim.
5. Exclusions — What Is NOT Covered
5.1. General Exclusions. The following are excluded from all supplemental coverage packages and the Renter bears full, unmitigated liability:
(a) Damage resulting from any prohibited use as defined in the Terms of Service (racing, off-road use, impaired driving, leaving Florida, etc.);
(b) Damage caused by operation of the vehicle by an unauthorized driver;
(c) Damage caused intentionally or through gross negligence by the Renter or authorized driver;
(d) Damage to the vehicle's undercarriage, including oil pan, exhaust system, and suspension components, caused by speed bumps, driveway transitions, road debris, or curbs;
(e) Damage to clutch, transmission, or drivetrain components caused by improper operation, including missed shifts, clutch burning, or launch control abuse;
(f) Engine damage resulting from use of incorrect fuel grade, fluid contamination, or overheating due to Renter ignoring warning indicators;
(g) Tire damage including punctures, blowouts caused by curb impact, and sidewall damage;
(h) Wheel and rim damage including curb rash, bending, and cracking;
(i) Interior damage including burns, tears, stains, and smoke/vape odor remediation;
(j) Key fob loss, damage, or replacement;
(k) Toll violations, traffic citations, parking tickets, and any government-imposed fines;
(l) Damage occurring while the vehicle is in the possession of a valet, car wash, or any third party;
(m) Any loss or damage occurring during operation of the vehicle for commercial purposes without prior written authorization.
5.2. Exotic & Supercar Specific Exclusions. In addition to the general exclusions, the following apply specifically to exotic and supercar class vehicles (Lamborghini, Ferrari, McLaren, Rolls-Royce, Bentley, Porsche 911 GT variants, and similar marques):
(a) Damage to carbon fiber body panels, carbon ceramic brake rotors, and specialty composite materials, which are exceptionally costly to repair or replace;
(b) Damage to active aerodynamic components (retractable spoilers, active vents, adjustable ride-height systems) caused by misuse or improper operation;
(c) Damage resulting from improper use of vehicle launch control, track mode, sport mode+, or similar performance features beyond normal driving conditions;
(d) Damage to hydraulic or electronic lift systems caused by failure to raise the vehicle over speed bumps, steep driveways, or other ground clearance hazards;
(e) Any engine or powertrain damage attributable to sustained high-RPM operation, mechanical over-rev, or exceeding manufacturer-recommended redline.
6. Claims Process
6.1. Step 1: Immediate Notification. Contact Musiaro at +1 (305) 555-0000 within one (1) hour of any incident. For emergencies, call 911 first, then contact Musiaro.
6.2. Step 2: Police Report. File a police report for any accident, collision, theft, or vandalism. Obtain the report number and the responding officer's badge number and name.
6.3. Step 3: Documentation. Photograph and video all damage, the accident scene, other vehicles involved, road conditions, and relevant signage. Collect all third-party information (names, phone numbers, insurance information, license plates, witness contact details).
6.4. Step 4: Written Incident Report. Submit a detailed written incident report to Musiaro within twenty-four (24) hours of the incident at hello@musiarorentals.com. The report should include date, time, location, description of events, weather conditions, road conditions, and any contributing factors.
6.5. Step 5: Insurance Claim Filing. The Renter must file a claim with their personal insurance carrier within forty-eight (48) hours and provide Musiaro with the claim number, adjuster name, and contact information.
6.6. Step 6: Damage Assessment. Musiaro will conduct a formal damage assessment within five (5) business days of vehicle return or incident. The assessment will include a detailed repair estimate from an authorized repair facility specializing in luxury and exotic vehicles.
6.7. Step 7: Resolution. Musiaro will coordinate with the Renter's insurance carrier and, if applicable, apply supplemental coverage. Any remaining balance after insurance and supplemental coverage will be charged to the Renter.
6.8. Failure to Follow Procedures. Failure to follow the claims process, including failure to file a police report, failure to notify Musiaro within the required timeframe, or failure to cooperate with the investigation, may void supplemental coverage and result in the Renter bearing full financial liability for all damages.
7. Deductible Structure
7.1. Without Supplemental Coverage. If the Renter does not purchase any Musiaro supplemental coverage package, the Renter is responsible for the full cost of all damage, loss of use, and diminished value, subject only to their personal insurance coverage.
7.2. Deductible Schedule with Supplemental Coverage:

7.3. Deductible Application. The deductible applies per incident. Multiple incidents during a single rental period each carry their own separate deductible. The deductible is the Renter's minimum financial exposure for covered claims; it does not cap liability for excluded losses.
7.4. Deductible Collection. Deductible amounts will be charged to the Renter's credit card on file upon completion of the damage assessment. If the credit card cannot be charged, payment is due within seven (7) business days of written invoice.
8. Third-Party Liability
8.1. Renter's Primary Responsibility. The Renter's personal automobile liability insurance shall serve as the primary source of coverage for all third-party bodily injury and property damage claims arising from the Renter's operation of the rental vehicle.
8.2. Indemnification. The Renter agrees to indemnify, defend, and hold harmless Musiaro from any and all third-party claims, lawsuits, judgments, settlements, and associated costs (including attorneys' fees) arising from the Renter's operation of the vehicle during the rental period.
8.3. Florida Financial Responsibility. The Renter acknowledges that under Florida law (F.S. 324), the operator of a motor vehicle must maintain financial responsibility. The Renter's compliance with the coverage requirements in Section 2 of this Policy satisfies this obligation. Any fines, penalties, or legal consequences for failure to maintain financial responsibility are solely the Renter's liability.
8.4. Musiaro's Liability Limitation. Musiaro shall not be vicariously liable for any injury, death, or property damage caused by the Renter's operation of the rental vehicle to the maximum extent permitted by Florida law, including under the Graves Amendment (49 U.S.C. 30106), which limits vicarious liability for vehicle rental companies.
9. Personal Belongings
9.1. Not Covered. Musiaro Rentals does not provide coverage for personal belongings, luggage, electronics, valuables, or any other personal property transported in or stored in the rental vehicle. This applies to all supplemental coverage packages except the Elite Protection Package, which provides limited personal effects coverage as described in Section 3.4(e).
9.2. Renter's Responsibility. The Renter is solely responsible for securing and insuring their personal belongings. We recommend the Renter check their homeowner's or renter's insurance policy for personal property coverage that may extend to items in a rental vehicle.
9.3. Liability Disclaimer. Musiaro shall not be liable under any circumstances for loss, theft, damage, or destruction of personal property left in the rental vehicle, whether such loss occurs during the rental period, at the time of vehicle return, or thereafter.
10. Coverage Gap — Vehicle Value Considerations
10.1. High-Value Vehicle Notice. Many vehicles in Musiaro's fleet have values ranging from $75,000 to over $500,000. Standard personal automobile insurance policies frequently cap comprehensive and collision coverage at the actual cash value (ACV) of the insured's own vehicle, which may be significantly less than the value of the rental vehicle.
10.2. Coverage Gap Risk. The Renter acknowledges and understands that a substantial gap may exist between: (a) the Renter's personal insurance coverage limits for rental vehicles; and (b) the full replacement or repair cost of the Musiaro rental vehicle. The Renter is personally and financially responsible for this entire gap.
10.3. Example. By way of illustration only: if a Renter's personal auto insurance provides collision coverage up to $100,000 for rental vehicles, and the rented vehicle (e.g., a Lamborghini Huracan) has a replacement value of $300,000, the Renter would be personally responsible for the $200,000 gap in the event of a total loss, plus any applicable deductibles, loss of use, and diminished value.
10.4. Supplemental Coverage Recommendation. Musiaro strongly recommends that all Renters, especially those renting exotic and supercar class vehicles, purchase a Musiaro supplemental coverage package (Section 3) to reduce their potential financial exposure. Additionally, Renters may wish to consult with their insurance agent about purchasing an umbrella policy or increasing their coverage limits for the rental period.
10.5. Acknowledgment. By proceeding with a rental, the Renter acknowledges that they have been advised of the potential coverage gap, have had the opportunity to review their personal insurance coverage, and accept full financial responsibility for any gap between their insurance coverage and the actual cost of loss or damage to the rental vehicle.
11. General Provisions
11.1. Subrogation. If Musiaro pays any claim under a supplemental coverage package, Musiaro shall be subrogated to the Renter's rights against any third party responsible for the loss. The Renter agrees to cooperate fully with Musiaro in pursuing any subrogation claims and shall not take any action to prejudice Musiaro's subrogation rights.
11.2. Fraud. Any fraudulent claim, misrepresentation of facts, or submission of false documentation in connection with an insurance claim or damage assessment shall void all supplemental coverage, result in forfeiture of all deposits and payments, and may result in criminal prosecution.
11.3. Modifications. Musiaro reserves the right to modify supplemental coverage packages, pricing, deductibles, and terms at any time. Changes will apply to rentals booked after the effective date of the modification.
11.4. Governing Law. This Policy shall be governed by the laws of the State of Florida. Disputes shall be resolved in accordance with the dispute resolution provisions in our Terms of Service.
