Rental Agreement

1. Parties & Scope of Agreement
1.1. This Rental Agreement ("Agreement") is entered into between Musiaro Rentals, LLC ("Musiaro," "Company," "we," or "our"), a Florida limited liability company with its principal place of business in Pembroke Pines, FL 33028, and the individual or entity identified as the Renter ("Renter," "you," or "your") who has been approved and confirmed for a vehicle rental through our platform.
1.2. This Agreement governs the specific terms and conditions of each vehicle rental transaction between the parties. It is supplementary to and incorporates by reference our Terms of Service, Privacy Policy, and Insurance Policy, all of which are available at musiarorentals.com.
1.3. In the event of any conflict between this Agreement and the Terms of Service, the more restrictive provision (from Musiaro's perspective) shall prevail. This Agreement supersedes any prior verbal or written agreements, representations, or understandings between the parties relating to the specific rental transaction.
1.4. By signing (electronically or physically) or otherwise accepting this Agreement, the Renter acknowledges having read, understood, and agreed to all terms and conditions set forth herein and in all incorporated documents.
2. Vehicle Delivery & Pickup
2.1. Delivery Service. Musiaro offers vehicle delivery and pickup services within our designated service areas throughout the State of Florida. Delivery and pickup locations must be confirmed at the time of reservation. Delivery fees vary based on distance from our primary location and are disclosed prior to booking confirmation.
2.2. Delivery Window. Deliveries are scheduled within a two (2) hour window of the agreed-upon time. Musiaro shall make reasonable efforts to deliver within this window but shall not be liable for delays caused by traffic, weather, prior rental overruns, or other circumstances beyond our reasonable control.
2.3. Renter Presence Required. The Renter (or a named authorized driver) must be physically present at the delivery and return location to sign the inspection reports and take or relinquish possession of the vehicle. The Renter must present a valid driver's license and credit card at the time of delivery.
2.4. Failed Delivery. If the Renter fails to be present at the agreed delivery location and time, and does not notify Musiaro at least two (2) hours in advance, a failed delivery fee of $250.00 shall apply. A second delivery attempt may be arranged at Musiaro's discretion, subject to availability and additional delivery charges.
2.5. Return Location. The vehicle must be returned to the location specified in this Agreement. Return to an alternate location requires prior written approval and may incur additional fees.
3. Vehicle Inspection Process
3.1. Pre-Rental Inspection. A comprehensive vehicle inspection shall be conducted jointly by Musiaro's representative and the Renter at the time of vehicle delivery. The inspection shall document the vehicle's exterior condition, interior condition, mileage, fuel level, tire condition, and any pre-existing damage or imperfections through written notation and time-stamped photographic/video evidence.
3.2. Pre-Rental Inspection Report. Both parties shall sign the Pre-Rental Inspection Report. The Renter's signature acknowledges agreement with the documented vehicle condition. Any pre-existing damage not noted on the inspection report at the time of delivery shall be presumed to have occurred during the rental period unless the Renter can provide clear and convincing evidence to the contrary.
3.3. Post-Rental Inspection. Upon vehicle return, a post-rental inspection shall be conducted by Musiaro's representative. The Renter is encouraged but not required to be present. Musiaro reserves the right to conduct a more detailed inspection within forty-eight (48) hours of vehicle return.
3.4. Discrepancies. Any discrepancies between the pre-rental and post-rental inspection reports shall constitute damage attributable to the Renter. Musiaro's documentation, including photographs, videos, and written reports, shall be considered prima facie evidence of damage.
3.5. Hidden Damage. Musiaro reserves the right to assess charges for damage discovered after the post-rental inspection that was not immediately apparent, including mechanical damage, undercarriage damage, and paint damage visible only under certain lighting conditions, provided such charges are documented and communicated to the Renter within fourteen (14) days of vehicle return.
4. Insurance Requirements
4.1. Mandatory Coverage. The Renter must maintain active automobile insurance coverage for the entire duration of the rental period. The Renter's insurance must provide coverage for the rental vehicle and must meet or exceed the following minimum requirements:
(a) Bodily Injury Liability: $300,000 per person / $300,000 per occurrence minimum;
(b) Property Damage Liability: $100,000 per occurrence minimum;
(c) Comprehensive Coverage: Required, with a deductible not exceeding $1,000;
(d) Collision Coverage: Required, with a deductible not exceeding $1,000;
(e) Uninsured/Underinsured Motorist Coverage: $100,000 per occurrence minimum.
4.2. Proof of Insurance. The Renter must provide a valid insurance declaration page or certificate of insurance prior to vehicle delivery. The insurance must be in the Renter's name and must explicitly cover rental vehicles. Musiaro reserves the right to verify coverage directly with the Renter's insurance provider.
4.3. Insurance Lapse. If the Renter's insurance coverage lapses, is cancelled, or is otherwise invalidated during the rental period, the Renter must immediately notify Musiaro and return the vehicle. Continued operation of the vehicle without valid insurance constitutes a material breach of this Agreement.
4.4. Primary Coverage. The Renter's personal insurance shall serve as primary coverage for any loss, damage, or liability arising during the rental period. Musiaro's insurance, if any, shall be secondary and excess only.
4.5. Coverage Gaps. The Renter acknowledges that the actual cash value of many vehicles in Musiaro's fleet may exceed standard insurance coverage limits. The Renter is responsible for any gap between their insurance coverage and the full replacement value of the vehicle. Please refer to our Insurance Policy for supplemental coverage options.
5. Authorized Drivers
5.1. Named Drivers Only. The rental vehicle may only be operated by drivers expressly named and approved on this Agreement. The primary Renter is automatically an authorized driver. All additional authorized drivers must be identified at the time of reservation or prior to vehicle delivery.
5.2. Driver Requirements. Each authorized driver must independently meet all eligibility requirements set forth in our Terms of Service, including but not limited to: minimum age of twenty-five (25) years, valid driver's license held for at least three (3) years, clean driving record, and adequate insurance coverage.
5.3. Additional Driver Fee. Each additional authorized driver beyond the primary Renter may be subject to an additional driver fee as disclosed at the time of booking.
5.4. Joint Liability. The primary Renter shall be jointly and severally liable for any and all damages, losses, fees, penalties, and obligations arising from the operation of the vehicle by any authorized driver.
5.5. Unauthorized Drivers. Operation of the vehicle by any person not listed as an authorized driver on this Agreement constitutes a material breach. All insurance coverage, damage waivers, and liability protections shall be immediately voided. The Renter shall be fully and exclusively liable for all damages, losses, and claims arising from unauthorized operation.
6. Accident & Incident Procedures
6.1. Immediate Notification. In the event of any accident, collision, damage, theft, vandalism, mechanical failure, or any other incident involving the rental vehicle, the Renter must immediately: (a) ensure the safety of all persons involved; (b) contact local law enforcement (call 911 for emergencies); and (c) notify Musiaro at +1 (305) 555-0000 within one (1) hour of the incident.
6.2. Police Report. A police report must be filed for any accident, collision, or theft, regardless of severity. The Renter must obtain the police report number and provide it to Musiaro. Failure to file a police report may void insurance coverage and result in full liability to the Renter.
6.3. Documentation. The Renter shall take photographs and videos of the scene, all vehicles involved, damage sustained, road conditions, and traffic signals/signs. The Renter shall also obtain the names, contact information, insurance details, and license plate numbers of all other parties involved, as well as contact information of any witnesses.
6.4. No Admission of Fault. The Renter shall not admit fault, liability, or responsibility to any party at the scene of an incident. The Renter shall not make any statements that could be construed as an admission of liability. All communications with other parties should be limited to the exchange of required information.
6.5. Cooperation. The Renter agrees to fully cooperate with Musiaro, its insurance providers, and its legal representatives in investigating and resolving any incident. This includes providing written statements, attending depositions or court proceedings, and providing access to any evidence within the Renter's possession.
6.6. Vehicle Not to Be Moved. Unless required for safety or directed by law enforcement, the Renter shall not move the vehicle from the scene of an accident until authorized by Musiaro or law enforcement. The Renter shall not authorize or arrange any repairs without prior written consent from Musiaro.
7. Theft Responsibility
7.1. Vehicle Security. The Renter is responsible for the security of the vehicle at all times during the rental period. The vehicle must be locked when unattended, with all windows fully closed and the key fob secured on the Renter's person. The vehicle must be parked in well-lit, secure locations.
7.2. Theft Liability. In the event of vehicle theft, the Renter is liable for the full replacement value of the vehicle unless: (a) a police report was filed immediately; (b) the Renter can demonstrate that reasonable security precautions were taken; (c) all vehicle keys and fobs are returned to Musiaro; and (d) the Renter fully cooperates with the investigation.
7.3. Key Responsibility. If the vehicle is stolen due to the Renter leaving keys in or on the vehicle, leaving the vehicle running and unattended, or failing to secure the vehicle, the Renter shall be solely and fully liable for the vehicle's full replacement value regardless of insurance coverage.
7.4. Parts & Component Theft. The Renter is responsible for the cost of replacing any parts, accessories, or components stolen from the vehicle during the rental period, including but not limited to wheels, catalytic converters, badges, mirrors, and interior components.
8. GPS Tracking & Telematics Consent
8.1. Tracking Disclosure. All vehicles in Musiaro's fleet are equipped with GPS tracking and telematics systems. By entering into this Agreement, the Renter expressly consents to the continuous monitoring and recording of the vehicle's location, speed, route, driving behavior, and diagnostic data throughout the rental period.
8.2. Purposes. GPS tracking data is used for: (a) vehicle security and theft prevention; (b) geofence monitoring (detecting if the vehicle leaves the State of Florida without authorization); (c) speed monitoring and reckless driving detection; (d) mileage verification; (e) vehicle recovery in the event of theft or unauthorized retention; and (f) accident reconstruction and claims support.
8.3. Geofence Alerts. The vehicle is geofenced to the State of Florida. Crossing state lines without prior written authorization will trigger an immediate alert and may result in termination of the rental, vehicle recovery, and forfeiture of all deposits.
8.4. Speed Alerts. Musiaro may set speed thresholds. Exceeding posted speed limits or preset speed thresholds may result in a warning notification to the Renter and, in cases of repeated or extreme violations, early termination of the rental.
8.5. Tampering Prohibited. Any attempt to disable, interfere with, obstruct, or tamper with the GPS tracking or telematics systems shall constitute a material breach of this Agreement and may be reported to law enforcement. The Renter shall be liable for all costs associated with system repair or replacement, plus a penalty fee of $2,500.00.
8.6. Data Retention. GPS and telematics data is retained in accordance with our Privacy Policy. The Renter waives any expectation of privacy regarding vehicle location and operation data during the rental period.
9. Towing & Recovery Costs
9.1. Renter-Caused Towing. If the vehicle requires towing due to any act, omission, or negligence of the Renter (including but not limited to accidents, running out of fuel, tire damage, mechanical abuse, or lockouts), all towing, recovery, storage, and transportation costs shall be borne exclusively by the Renter.
9.2. Unauthorized Retention Recovery. If Musiaro initiates vehicle recovery due to late return, unauthorized use, geofence violation, or any breach of this Agreement, the Renter shall be liable for all recovery costs including but not limited to towing fees, transport fees, agent dispatch costs, storage fees, and a recovery administration fee of $500.00.
9.3. Mechanical Failure. In the event of a genuine mechanical failure not caused by the Renter's misuse, Musiaro will arrange and bear the cost of towing to the nearest authorized repair facility. The Renter must contact Musiaro before arranging any towing services. Unauthorized towing may not be reimbursed.
9.4. Flatbed Only. All Musiaro vehicles must be transported exclusively via flatbed tow truck. Under no circumstances shall the vehicle be towed using a hook-and-chain, wheel-lift, or dolly method. Damage caused by improper towing methods shall be the Renter's responsibility if the Renter arranged or authorized the towing.
10. Early Termination
10.1. Termination by Renter. The Renter may return the vehicle before the scheduled end date. Early returns do not entitle the Renter to any refund of unused rental days, prepaid mileage packages, or delivery fees. The full rental amount as agreed at booking remains due and payable.
10.2. Termination by Musiaro. Musiaro reserves the right to terminate this Agreement and demand immediate return of the vehicle at any time, with or without cause, including but not limited to: (a) breach of any term of this Agreement; (b) reckless or dangerous driving behavior detected via GPS/telematics; (c) geofence violation; (d) suspicion of illegal activity; (e) insurance lapse or invalidation; (f) failure of the Renter's credit card to process additional charges; or (g) any other reason at Musiaro's sole discretion.
10.3. Renter Obligations Upon Termination. Upon notice of termination, the Renter must immediately cease operation of the vehicle, secure it in a safe location, and arrange for return or pickup as directed by Musiaro. Failure to comply with termination instructions within two (2) hours may result in vehicle recovery action and associated costs.
10.4. No Refund for Cause. If the Agreement is terminated by Musiaro due to the Renter's breach, no refund of any amounts paid shall be issued. The Renter remains liable for any outstanding charges, penalties, and damages.
11. Renter Warranties & Representations
11.1. By entering into this Agreement, the Renter warrants and represents that:
(a) The Renter holds a valid, unrestricted driver's license that has been held continuously for at least three (3) years and is not currently suspended, revoked, or subject to any restrictions that would impair the ability to safely operate the rental vehicle;
(b) The Renter has no history of DUI, DWI, reckless driving convictions, or vehicular felonies;
(c) The Renter has not had a driver's license suspended or revoked within the past five (5) years;
(d) The Renter maintains active automobile insurance that meets or exceeds the coverage requirements specified in Section 4 of this Agreement;
(e) All information provided to Musiaro, including personal identification, insurance details, and driving history, is truthful, accurate, and complete;
(f) The Renter is medically and physically fit to safely operate a motor vehicle;
(g) The Renter has read and understands all terms, conditions, and policies referenced in this Agreement.
11.2. Consequences of Misrepresentation. Any material misrepresentation by the Renter shall constitute a breach of this Agreement and may result in immediate termination, forfeiture of all deposits and payments, full liability for damages, and potential legal action including fraud claims.
12. Vehicle Owner Listing Terms
12.1. Applicability. This section applies to individuals or entities ("Vehicle Owner" or "Owner") who list their luxury or exotic vehicles on the Musiaro Rentals platform through our "List Your Car" program.
12.2. Owner Eligibility. The Vehicle Owner must hold clear title to the vehicle or have express written authorization from the lienholder to list the vehicle for rental. The Owner must provide proof of ownership (title or registration), current insurance documentation, and a complete vehicle history report.
12.3. Vehicle Standards. Listed vehicles must meet Musiaro's quality and condition standards, which include: model year no older than five (5) years from the current date (exceptions at Musiaro's discretion for classic and collectible vehicles), clean title with no salvage or rebuilt designation, mileage within acceptable ranges for the vehicle class, excellent mechanical and cosmetic condition, and current state registration and emissions compliance.
12.4. Revenue Sharing. Revenue sharing between Musiaro and the Vehicle Owner shall be as agreed in a separate Vehicle Listing Agreement. Musiaro's standard commission rate and payout schedule will be disclosed prior to listing activation. Musiaro reserves the right to set rental pricing for listed vehicles.
12.5. Vehicle Care. Musiaro will exercise reasonable care in the management and operation of listed vehicles, including professional detailing between rentals, secure storage when available, and coordination of routine maintenance. However, Musiaro shall not be liable for normal wear and tear, depreciation, or damage caused by renters to the extent covered by insurance and renter liability provisions.
12.6. Owner Insurance. The Vehicle Owner must maintain comprehensive and collision insurance on the listed vehicle at all times. Musiaro's fleet insurance provides supplemental coverage during active rental periods only. The Owner's insurance shall be primary for non-rental periods.
12.7. Listing Removal. Either party may terminate a vehicle listing with thirty (30) days' written notice. Any confirmed reservations within the notice period must be honored unless mutually agreed otherwise. The Owner shall not remove or recall the vehicle during an active rental.
12.8. Indemnification by Owner. The Vehicle Owner represents and warrants that the vehicle is in safe, roadworthy condition and free from known defects. The Owner agrees to indemnify Musiaro against any claims arising from pre-existing mechanical defects, undisclosed damage, title disputes, or lien issues.
13. General Provisions
13.1. Entire Agreement. This Agreement, together with the Terms of Service, Privacy Policy, Insurance Policy, and any vehicle-specific addenda, constitutes the entire agreement between the parties regarding the rental transaction.
13.2. Waiver. No failure or delay by Musiaro in exercising any right shall constitute a waiver of that right. A waiver of any term on one occasion shall not be deemed a waiver on any subsequent occasion.
13.3. Assignment. The Renter may not assign, transfer, or delegate any rights or obligations under this Agreement without Musiaro's prior written consent. Musiaro may freely assign this Agreement.
13.4. Notices. All notices under this Agreement shall be in writing and sent to the email addresses on file. Notices from Musiaro shall be effective upon sending. Notices from the Renter shall be effective upon confirmed receipt by Musiaro.
13.5. Governing Law. This Agreement shall be governed by the laws of the State of Florida. Disputes shall be resolved in accordance with the dispute resolution provisions in our Terms of Service.
